# Terms of Service & Fair Use Policy

> Terms of service, resource limits, and Fair Use Policy (FUP) for Aisbir Cloud Nusantara

These Terms and Conditions govern the use of all services provided by **Aisbir Cloud Nusantara**, including Pterodactyl Panel, DirectAdmin Web Hosting, VPS, and related cloud services.

## 1. Acceptance of Terms

By registering, purchasing, or using any services from **Aisbir Cloud Nusantara**, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and our **Fair Use Policy (FUP)**.

## 2. Fair Use Policy (FUP) & Resource Governance

All plans operating on shared infrastructure are subject to our Fair Use Policy to maintain stability and performance for all users sharing the physical host nodes.

### A. Pterodactyl Panel (RAM & CPU Limits)

<Warning>
  **RAM & CPU Sustained Usage Limits**:
  If you purchase a service with a defined resource allocation (e.g. **4 GB RAM**), you **CANNOT use 100% of the RAM every hour continuously** or maintain an ongoing burst workload.
</Warning>

* **RAM / Memory Allocation**: Your plan's RAM allocation is an upper ceiling (*peak headroom*), not a 24/7 continuous utilization benchmark. Running applications near 100% RAM non-stop risks destabilizing the host node, and the container will automatically be terminated by the kernel (*Out of Memory / OOM Killed*).
* **CPU Usage**: Average CPU usage exceeding **85% sustained over a 1-hour window** will be automatically capped (*CPU throttling*). Persistent CPU overload threatening node performance may result in temporary suspension.
* **Disk I/O**: Disk read/write operations must remain within reasonable thresholds. Scripts or bots causing excessive *IOWait* on shared enterprise NVMe arrays will have their I/O throughput restricted.

### B. DirectAdmin Web Hosting

* **Storage Usage**: Hosting disk allocations are **strictly reserved for legitimate website files** (HTML, PHP, CSS, JS, MySQL databases, and media assets linked directly to your web pages).
  * **Prohibited**: Utilizing hosting space as external backup storage, personal cloud/file-lockers, movie/music sharing hubs, or public download mirrors.
* **Email Rate Limits**: Outbound emails are limited to **200 emails per day per account** to protect mail server IP reputation and eliminate spamming activities.
* **CPU & Memory**: Each hosting account operates under CloudLinux/cgroup thresholds. Scripts causing runaway infinite loops or high server loads will be automatically throttled.

## 3. Refund & Payment Policy

* **No Refund**: All products, service subscriptions, and deposit top-ups are strictly **Non-Refundable** once processed.
* **Exceptions**: In the event of a critical service disruption originating solely from Aisbir Cloud Nusantara infrastructure, refunds will be credited as **Account Balance (Credit)** in the client area.

## 4. Account Security & Device Limits

* **Account Limits**: Each individual customer/device is permitted to register **1 account only** to prevent promotional abuse and fraud.
* **User Responsibility**: You are solely responsible for maintaining the confidentiality of your login credentials and API keys.

## 5. Strictly Prohibited Content & Activities

Aisbir Cloud Nusantara operates under Indonesian legal jurisdiction. We enforce a zero-tolerance policy against:

    Any form of cryptocurrency mining (crypto mining) is strictly prohibited and results in immediate permanent termination.

    Hosting online gambling websites, betting bots, or casino scripts is strictly forbidden.

    Phishing sites, malware hosting, botnet C2 servers, spam bots, or digital scams.

  <Card title="DDoS & Network Abuse" icon="network-wired" color="#ef4444">
    DDoS attacks, network stressers, open proxies, port scanning, or torrent seeding.
  </Card>

## 6. Suspension & Service Termination

Aisbir Cloud Nusantara reserves the right to suspend or terminate any service without prior notice if a violation of these terms occurs, in order to protect overall system integrity.

## 7. Policy Amendments

We reserve the right to amend these terms at any time. Updates take effect immediately upon publication on this documentation portal.
